Al’right, which one of you yuppie born-with-silver-spoon-in-mouth-golden-toilet seat-up-your-ass-citizens pushed for a law to ticket the homeless? Yes, that’s right folks; there are San Diegans who want to TICKET the homeless. For SLEEPING, no less. My, how much more anti-Jesus can you get?
First of all, that is just downright heartless. You say we have a problem with homeless people on the streets? Fine, then DO something about it. Push your political representatives to build more shelters, get your butt off of that lazy-boy $700 easy-chair and use your money or your labor to better the situation. What? You don’t want to do that? Oh that’s right, because it’s not your problem is it? Because the homeless are substandard citizens that should just get a one way ticket (pun intended) out of your pristine little Stepford town and be someone else’s problem.
The thing is, these San Diegans don’t really want to remedy the situation, and the only motivation behind ticketing the homeless is to drive homeless people out of San Diego. The reality is, ticketing the homeless can only create more problems. Why you ask? Because these people are freaking HOMELESS. That means they won’t have the money to pay the fine, and if a ticket does not come with a fine, then what good is ticketing? What incentive will the homeless have to not sleep in public places if all they get is a piece of paper with no consequences? So they can’t pay, and then what? Track them down? Tell them to appear in court to pay the fine? And just how do you plan on notifying them to appear in court? Send them a letter to their respective homes? Oh that’s right, they are HOMELESS! Let’s say you do get a hold of them and they don’t appear in court (they won’t), then what? Send out a bench warrant and charge them for FTAs (Failure to appear, a criminal charge)? Yeah, because our court system have plenty of room for even more cases, because our dockets are not already piled up to the whazoo. Idiots.
So you see, ticketing the homeless will create more problems in the court system. City Attorneys, Public Defenders, District Attorneys are already overworked, our court system’s docket is overfilled, no one in their right mind should prosecute a homeless person for a FTA. The main reason for ticketing the homeless is a scare tactic. It is using a megaphone on a high horse shouting unequivocally, “GET OUT!” Listen, I just came face to face the other day with a fellow San Diegan, quite possibly your neighbor, who stabbed a 24 year-old woman 70 times in the face with a garden shear before attempting to rape her. If you think that homeless people are the problems in your city, you need a reality check.
So far, nine homeless people who have been cited for illegal sleeping - one while she waited in vain for a shelter bed - have filed a class-action lawsuit in San Diego federal court. These people insist that they would not have to sleep outside if there were enough shelters. And the advocate for these people? A group of attorneys presenting the interesting argument that depriving these people of a place to sleep constitute sleep depravation and therefore a cruel and unusual punishment under the 8th Amendment.
With a law like this, it is no wonder this city has corrupt politicians and is on the verge of bankruptcy. I wouldn’t be surprised if a swarm of locus sweeps through this fine city next week.
